1. About these terms
These terms apply to NEXO CPMS, provided by Etiris d.o.o., Mostar, Bosnia and Herzegovina (“Etiris”, “we”): this website, the driver apps and web checkout (including versions branded for a charging operator) and the back office. By using any of them you accept these terms. If you do not accept them, do not use the service.
2. The charging service
Your contract for charging is with the operator shown at the charger and in the app. The operator sets prices, opening hours and availability and is responsible for the chargers. NEXO is the software that runs the operator’s network, takes payments and issues receipts on the operator’s behalf.
3. Prices and payment
- The price of a session (energy, time, parking or idle fees and VAT, as the operator sets them) is shown before you start.
- Before a session we may pre-authorise an amount on your card. After the session only the actual cost is charged and the rest of the pre-authorisation is released. How quickly released funds appear depends on your bank.
- Card payments are processed by Monri or Stripe under their own terms. Customers with a contract may be billed after the period instead, as agreed with their operator.
- A receipt is shown at the end of the session and an invoice is sent by email.
4. Accounts
You must be at least 18 to create an account. Keep your details accurate and your sign-in credentials safe, and tell us if you suspect misuse. If you sign in with Google or Apple, their terms also apply. You can ask for your account to be deleted at any time.
5. Acceptable use
Do not:
- break the law or the rights of others while using the service;
- try to access accounts, chargers or systems you are not authorised to use;
- interfere with chargers, the platform or other users’ sessions;
- copy, resell or reverse-engineer the service except where the law allows it.
6. Operators and business customers
Operators and businesses using the back office do so under a separate agreement with Etiris. These terms apply where that agreement does not say otherwise.
7. Intellectual property
The NEXO software, design and content belong to Etiris or its licensors. Operator names and logos belong to the operators. You get a personal, non-transferable right to use the apps and website for their intended purpose.
8. Third-party services
The service relies on third parties such as payment providers, Google and Apple sign-in, app stores and roaming partners. We are not responsible for their services; their own terms apply.
9. Availability
We work to keep NEXO available, but we do not guarantee uninterrupted service. Charging also depends on the charger, its connection and the operator.
10. Disclaimers and limitation of liability
The service is provided as it is. To the extent the law allows, Etiris is not liable for indirect or consequential loss, such as lost profit or data, arising from use of the service. Nothing in these terms limits liability that cannot be limited by law, or your mandatory rights as a consumer.
11. Governing law
These terms are governed by the laws of Bosnia and Herzegovina, and the courts in Mostar have jurisdiction. If you are a consumer, the mandatory consumer protection rules of your country of residence still apply.
12. Changes to these terms
We may update these terms. The date at the top shows the current version; significant changes are announced in the app or by email.
